The Advocates: Zoning Regulations and Their Impact: Trick or Treat Edition

Zoning regulations play a crucial role in shaping the physical and economic landscape of cities and towns. They govern how land can be used, determining what types of businesses can operate in specific areas. However, when these regulations become outdated and fail to adapt to the changing needs of communities, they can have detrimental effects on the local business environment. I recently heard someone very wise say, ”zoning can either create wealth or take it.“ For this reason, it is crucial that we amplify the voices of our community that believe in the shared vision of economic prosperity.

Currently, we are in a unique opportunity where zoning and planning is being re-examined in multiple places. Berkeley, Dorchester and Charleston counties have created frameworks for updating their respective comprehensive plans. The City of Charleston is preparing to embark on a city-wide zoning rewrite, something that they haven’t done in over 50 years. The Chamber will continue to engage municipalities, and we want you to be informed about why this is so important.

To highlight these critical needs, let us play a small round of Trick or Treat. I’ll list a type of zoning or zoning-related practice, and you’ll have to guess whether it’s a trick or a treat.

Accessory Dwelling Units (ADUs)
Treat! ADUs, like mother-in-law suites and basement apartments, allow property owners to make supplemental income as landlords while simultaneously adding to the housing supply without the need for land acquisition.

Single-Use Zoning
Trick! While the concept of separating single-family construction is traditional and aspirational for a few first-time homebuyers, limiting too many sites for only one purpose can create serious challenges for commuters. Have you ever sat in traffic and thought, “Wow, I’m glad I live so far from the nearest grocery store”? Me neither. 

Minimum Setback Requirements
Depends on who you ask. Setback requirements can clarify property lines and create opportunities for more green space. Regulation without practicality, however, can lead to inefficient land use and less walkable neighborhoods. This could be a trick or a treat depending on the needs of the community.

Adaptive Reuse Zoning
Treat! Vacant buildings can be repurposed for new businesses, housing and even civic services. This also can provide a more affordable option for development if the building structures need minimal repair.

These are just a few of the policies we’ll be monitoring as our local governments re-examine their zoning ordinances. As we look ahead to the future of our region, it’s important that we create zoning regulations that create more than they take away. If we are not growing, we are declining and that is spookier than anything you’ll see this Halloween.
